Agiloft Privacy Policy

Agiloft, Inc. complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Agiloft, Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. The certification can be found at https://www.privacyshield.gov/list. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Scope

Agiloft, Inc. adheres to the principles of the EU-U.S. Privacy Shield Framework with respect to personal data submitted by Agiloft, Inc.’s customers in reliance on the Privacy Shield to Agiloft, Inc.’s cloud hosting services.

Processed Data

Agiloft, Inc. provides online tools that our customers use to operate aspects of their businesses. These include tools for customer relationship management, and customer service, among others. In providing these tools, Agiloft, Inc. processes data our customers submit to our services. While Agiloft, Inc.’s customers decide what data to collect and process using Agiloft, Inc.’s software tools, it typically includes information about their customers, contracts, prospects, and employees, such as contact information, purchases, and billing information.

Transfer of Personal Information

Agiloft, Inc. does not, and will not, transfer personal information to third parties. Therefore, the provision of Privacy Shield regarding liability for the actions of agent processors does not apply.

Your Rights to Access, to Limit Use, and to Limit Disclosure

EU individuals have rights to access personal data about them, and to limit use and disclosure of their personal data. With our Privacy Shield certification, Agiloft, Inc. has committed to respect those rights. Agiloft, Inc. personnel have limited ability to access the data our customers submit to our services. If you wish to request access to — or to limit use or disclosure of — your personal information, please provide the name of the Agiloft, Inc. customer who submitted your data to our services. We will refer your request to that customer, and will support them, as needed, in responding to your request.

Inquiries and Complaints

If you believe Agiloft, Inc. maintains your personal data in one of the services within the scope of our Privacy Shield certification, you may direct any inquiries or complaints concerning our Privacy Shield compliance to security@agiloftlif1stg.wpenginepowered.com. Agiloft, Inc. will respond within 45 days.

An individual has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms. For details please visit https://www.privacyshield.gov/article?id=ANNEX-I-introduction.

U.S. Federal Trade Commission Enforcement

The Federal Trade Commission has jurisdiction over Agiloft, Inc.’s compliance with the Privacy Shield. Agiloft, Inc.’s commitments under the Privacy Shield are subject to the investigatory and enforcement powers of the United States Federal Trade Commission.

Compelled Disclosure

Agiloft, Inc. may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
